Terms and Conditions of Sale

These Terms and Conditions (“Terms”) govern the sale of products by Eshi (“we”, “us”, “our”) to you (“you”, “your”, “the customer”) via our website www.eshiunderwear.co.uk (“the Website”). By placing an order or interacting with our site, you agree acknowledge agreement to our Terms.

Please read all Terms carefully before placing your order.

 

1. Company Information

Eshi is a trading name of Eshi Underwear Ltd, a company incorporated and registered in England and Wales under company number 16129578, with its registered office at Ridings Park, Eastern Way, Cannock. 

 

2. Formation of Contract

2.1 By placing an order with Eshi, you are making an offer to purchase goods subject to these Terms.
2.2 We will acknowledge receipt of your order by email. This acknowledgement does not constitute acceptance of your order. A legally binding contract shall be formed between us when we dispatch the goods to you and send you confirmation of dispatch.
2.3 We reserve the right to decline any order before dispatch for reasons including, but not limited to, product unavailability, pricing or description errors, or suspicion of fraudulent activity.

 

3. Product Information

3.1 We make every reasonable effort to ensure that product descriptions, images, and prices appearing on the website are accurate. Minor variations (including but not limited to colour, lace detailing, or finish) may occur.
3.2 All prices on the UK website are stated in Pounds Sterling (GBP) and include VAT at the prevailing rate, unless otherwise stated.
3.3 We reserve the right to adjust prices from time to time without notice. Such changes will not affect pre-existing orders that have already been accepted.

 

4. Payment

4.1 Payment must be made in full at the time of placing the order.
4.2 We accept payment methods as displayed on the website at checkout.
4.3 You confirm that any payment method used is lawfully owned or authorised by you.

 

5. Delivery

5.1 Delivery charges and estimated timescales are set out on the website and are confirmed at checkout.
5.2 Whilst we will use reasonable endeavours to ensure delivery within the stated timescales, we shall not be liable for delays caused by circumstances beyond our reasonable control, including but not limited to courier delays or customs clearance.
5.3 Risk of loss or damage to the goods passes to you on delivery. Title to the goods shall pass to you once full payment has been received.

 

6. Returns and Refunds

6.1 Subject to clause 6.3, you have the right to cancel your order within 14 days of receipt in accordance with the Consumer Contracts Regulations 2013. You must notify us in writing of your decision to cancel. You then have a further 14 days to return the goods.
6.2 In addition, we operate a goodwill returns policy, allowing returns or exchanges within 28 days of receipt, subject to the conditions set out below.
6.3 For hygiene reasons, returns of underwear are only accepted if:

  • The hygiene strip remains intact, secure, and untampered with; and
  • The goods are unworn, unwashed, in their original packaging, and with all tags attached.
    6.4 We reserve the right to refuse a refund or exchange if the returned goods do not comply with the above requirements.
    6.5 Refunds will be processed within 14 days of receipt of returned goods, using the original payment method. Delivery charges are non-refundable unless the goods are faulty or misdescribed.

 

7. Faulty Goods

7.1 If the goods are faulty or misdescribed, you are entitled to a remedy under the Consumer Rights Act 2015. This may include a repair, replacement, or refund.
7.2 You must notify us of any faults within a reasonable period of discovery, and in any event within 14 days of receipt.

 

8. Promotional Offers

8.1 Promotional discounts or codes must be applied at the time of purchase and cannot be applied retrospectively.
8.2 Promotional offers may not be combined unless expressly stated.
8.3 We reserve the right to amend or withdraw promotions at any time.

 

9. Intellectual Property

9.1 All intellectual property rights on the website and its content, including and without limitation to, trademarks, logos, designs, images, text, and graphics, are owned by or licensed to Eshi.
9.2 You may not copy, reproduce, distribute, or otherwise use any content without our prior written consent.

 

10. Liability

10.1 Nothing in these Terms shall limit or exclude our liability for:

  • Death or personal injury caused by our negligence;
  • Fraud or fraudulent misrepresentation; or
  • Any matter for which liability cannot be lawfully excluded.
    10.2 Subject to clause 10.1, our liability to you in respect of any claim arising under or in connection with these Terms shall not exceed the price paid for the goods in question.
    10.3 We shall not be liable for any indirect, special, or consequential losses, including but not limited to loss of profit, loss of business, or loss of goodwill.

 

11. Governing Law and Jurisdiction

11.1 These Terms are governed by and construed in accordance with the laws of England and Wales.
11.2 Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

 

12. Amendments

We reserve the right to update or amend these Terms from time to time. Any such changes shall be effective when posted on the website and shall not affect contracts already concluded.
